Term of service

Article 1 (Application)

  1. This agreement (hereafter referred to as "this agreement") governs all relations between the user and us, A Cup Studio (hereafter referred to as "the company"), regarding the use of the online shop (hereafter referred to as "this service") we provide on this website.
  2. In addition to this agreement, we may make various provisions (hereinafter referred to as "individual provisions") concerning the use of this service. These individual provisions shall constitute a part of this agreement, regardless of their name.
  3. In the event of a conflict between the provisions of this agreement and the individual provisions, the individual provisions shall take precedence, unless otherwise specified in the individual provisions.

Article 2 (Registration)

  1. Registration is completed when the applicant agrees to this agreement, applies for registration in the method we specify, and we notify the applicant of our acceptance of the application.
  2. We may not approve registration applications under certain circumstances, and we are not obliged to disclose the reasons. These circumstances include:
    2-1. When false information is submitted when applying for registration.
    2-2. When the application is from someone who has previously violated this agreement.
    2-3. Other cases where we determine that registration is inappropriate.

Article 3 (Management of User ID and Password)

  1. Users shall manage their own user ID and password for this service at their own responsibility.
  2. Under no circumstances may users transfer, lend, or share their user ID and password with a third party. We consider the use of a user ID and password combination that matches the registered information as the use by the registered user.
  3. We are not responsible for any damages caused by the use of a user ID and password by a third party, except in cases where we have intentional or gross negligence.

Article 4 (Sales Contract)

  1. A sales contract is established when a user submits a purchase request to us and we notify the user of our acceptance of the request. Ownership of the product is transferred to the user when we hand over the product to the delivery company.
  2. We may terminate the sales contract without prior notice to the user under certain circumstances. These circumstances include:
    2-1. When the user violates this agreement.
    2-2. When delivery of the product is unable to be completed due to an unknown delivery address or long-term absence.
    2-3. Other cases where the trust relationship between us and the user is damaged.
  3. Payment methods, delivery methods, cancellation methods for purchase requests, or return methods for this service are subject to the methods we separately specify.

Article 5 (Intellectual Property Rights)
The copyrights and other intellectual property rights for product photos and other contents (hereafter referred to as "contents") provided by this service belong to us, the content provider, and other legitimate right holders. Users may not reproduce, redistribute, modify, or otherwise use these contents without permission.

Article 6 (Prohibited Acts)
Users shall not engage in any of the following acts when using this service.

  1. Acts that violate laws or public morals.
  2. Acts related to criminal activities.
  3. Acts that infringe on copyrights, trademark rights, and other intellectual property rights included in this service.
  4. Acts that destroy or interfere with the function of our server or network.
  5. Commercial use of information obtained from this service.
  6. Acts that could hinder the operation of our service.
  7. Unauthorized access or attempts to do so.
  8. Collection or storage of personal information about other users.
  9. Impersonation of other users.
  10. Acts that directly or indirectly provide benefits to anti-social forces in relation to our service.
  11. Other acts that we judge to be inappropriate.

Article 7 (Suspension of Service)

  1. We may suspend or interrupt the provision of all or part of this service without prior notice to the user under certain circumstances. These circumstances include:
    1-1. When performing maintenance or updates on the computer system for this service.
    1-2. When the provision of this service becomes difficult due to a disaster such as an earthquake, thunderbolt, fire, power outage, or other force majeure.
    1-3. When a computer or communication line is stopped due to an accident.
    1-4. Other cases where we determine that the provision of this service is difficult.
  2. We are not responsible for any disadvantage or damage suffered by the user or a third party due to the suspension or interruption of the provision of this service, regardless of the reasons.

Article 8 (Restriction of Use and Cancellation of Registration)

  1. We may restrict all or part of the use of this service or cancel the registration of a user without prior notice if the user violates any of the following. These violations include:
    1-1. Violation of any of the provisions of this agreement.
    1-2. Discovery of false information in the registration information.
    1-3. Suspension of the credit card reported as a payment method by the user.
    1-4. Failure to pay fees or other debts.
    1-5. No response for a certain period of time to our contact.
    1-6. No use of this service for a certain period of time after the final use.
    1-7. Other cases where we determine that the use of this service is inappropriate.
  2. We are not responsible for any damages suffered by the user as a result of our actions based on this article.

Article 9 (Withdrawal)
Users can withdraw from this service by following the withdrawal procedures we specify.

Article 10 (Disclaimer and Liability Exemption)

  1. We do not warrant that this service is free from actual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, security, etc., errors, bugs, and rights infringement).
  2. We are not liable for any damage to the user caused by this service. However, if the contract between us and the user regarding this service is a consumer contract under the Consumer Contract Act, this liability exemption does not apply. In this case, however, we are not liable for any damages caused by our negligence (excluding gross negligence) in breach of our obligations or illegal acts to the extent that they are extraordinary damages (including cases where we or the user foresee or could foresee the occurrence of damages).
  3. We are not liable for any transactions, communications, or disputes that occur between the user and other users or third parties in connection with this service.

Article 11 (Change of Service Content)
We may change the content of this service or suspend the provision of this service without notice to the user, and we are not liable for any damages suffered by the user as a result.

Article 12 (Change of Terms of Use)
We may revise this agreement at any time without notice to the user if we deem it necessary. If the user starts using this service after the revision of this agreement, it is considered that the user has agreed to the revised agreement.

Article 13 (Handling of Personal Information)
We will handle personal information obtained through the use of this service in an appropriate manner in accordance with the "Privacy Policy" of our company.

Article 14 (Notice or Contact)
Notices or contacts between the user and us shall be made in the manner we specify. We consider the currently registered contact information to be valid and send notices or contacts to that contact information, considering them to have reached the user at the time of sending, unless we receive a change notification from the user in a manner we separately specify.

Article 15 (Prohibition of Assignment of Rights and Obligations)
Users may not assign their contractual position in the use agreement or the rights and obligations based on this agreement to a third party or provide them as collateral without our prior written consent.

Article 16 (Governing Law and Jurisdiction)

  1. Hong Kong law shall be the governing law for the interpretation of this agreement. However, the United Nations Convention on Contracts for the International Sale of Goods shall not apply to this service.
  2. If a dispute arises in connection with this service, the court with jurisdiction over the location of our main office shall be the exclusive court of competent jurisdiction.
